Clinical Negligence - Low Cost Investigation Scheme
If you do not have legal expenses insurance and you are not eligible for public funding (formerly known as legal aid ) then we may be able to offer you a no win, no fee agreement.
In some cases e.g. if the hospital has admitted fault as part of the complaints procedure we will be able to offer you a no win, no fee agreement straight away. In most cases however it will be necessary to investigate the case to see whether it is likely to succeed.
That will involve amongst other things:
- obtaining all of your relevant GP and hospital records
- preparing a detailed witness statement for you
- instructing one or more experts to prepare a report.
Although if you are able to afford it this is the best way of proceeding (because you should end up with a definitive answer and we do all the work) as an alternative we offer a lower cost, fixed price investigation scheme.
Under this
- you will need to obtain your own GP and hospital records (although we will provide you with precedent letters)
- you will need to provide a full medical history prior to and including the negligent treatment and afterwards
- we will obtain an initial screening report from an expert which will clearly not be as detailed and thorough
