Do's and Don'ts of clinical negligence
Dos
- do make a complaint through the NHS complaints procedure within 6 to 12 months of the incident arising
- do keep a record of their name if you are treated by a locum GP
- do keep a record of all of your appointments – who you saw, when and what they said to you
- do ask the person treating you for an explanation of what has happened
- do keep a record of your symptoms and how they have affected your life
- do make a detailed note of any assistance given to you by your friends or family i.e. what exactly they did for you, when, and how much time they spent
- do keep a record of all your losses and expenses
- do instruct a solicitor who specialises in medical negligence claims
Don’ts
- don’t incur any unreasonable expenses
- don’t throw away receipts for medication or any other losses and expenses related to your ongoing health problems
- don’t settle your claim or any part of it without reference to us
- don’t accept at face value comments by those treating you that what has gone wrong is ‘just one of those things’
