Misrepresentation
Sometimes you sign a contract because of what you have been told.
Promises and representations may have been made but they are not referred to in the contract you have signed.
You then find that the promises and representations are untrue and you are not receiving what you thought you were getting.
Depending on the nature of the representations if they turn out to be untrue you may be able to:
- cancel the order
- claim damages
- do both
The remedy will vary depending on whether the misrepresentation was innocent, negligent or fraudulent.
