Injunctions
Not all disputes are about money. Sometimes it is about stopping someone from doing something or making them do something. An Injunction is an order of the court requiring someone to take certain steps or refrain from doing so. Often they need to be obtained as a matter of urgency to maintain the status quo pending a negotiated settlement or the court reaching a final decision.
The rand of injunctions which can be obtained include freezing orders, search and seizure orders, mandatory injunctions (requiring someone to do something), prohibiting injunctions (requiring someone to stop doing something).
We have obtained injunctions:
- preventing former employees poaching clients or staff
- requiring the return of items sold in the absence of payment where there was a retention of title
- requiring the removal or construction of fences, trees, walls or hedges
- enforcing restrictive covenants and obligations under a contract
- preventing the removal of funds or assets from England and Wales
We can advise on whether an injunction is the right step to take, both commercially and generally, or whether there are better options. A warning letter from us often encourages the other side to take stock of their position and settlement can be achieved without court proceedings. However if urgent action is needed we will work to a tight timetable including obtaining injunctions out of normal business hours.
