Breach of Lease or Tenancy
If you are a landlord it is important to check on a regular basis that your tenants are complying with all of their obligations under your agreement with them. If you are the freehold owner you do not want the actions of your tenant affecting the value of your freehold. Alternatively you do not want to find yourself in breach of your own head lease if you yourself are a tenant.
We regularly advise landlords in respect of breaches by tenants of their covenants. In particular we can help with taking action against the tenant to ensure they put the breach right within a reasonable time.
Examples of typical breaches include:
- non-payment of rent or service charge
- breach of user covenant
- breach of alienation covenant
- breach of assignment or a covenant against subletting
- the carrying out of unauthorised alterations
