Obtaining Possession

We regularly act for both residential and commercial landlords in recovering possession of premises let under an assured short hold tenancy, a licence, a long lease or a commercial lease.

The main reasons for seeking possession of property or forfeiture of a lease include:

  • rent arrears
  • that the fixed period of the tenancy has come to an end but the tenant has not vacated
  • that the tenant is in breach of any one of their obligations under the lease or tenancy agreement
  • that the landlord requires the premises for redevelopment

This is a complex and heavily regulated area of law.  A failure to follow the correct procedure not only delays an application for possession but can invalidate the whole process. Wrongful re-entry by a landlord without a court order can give rise to claims for damages by the tenant for unlawful eviction and trespass.
