Discrimination
Discrimination is a difficult area of law and covers a whole range of areas such as race, religion, sex, sexual orientation, marital status, disability and age. (The European Human Rights Convention adds discrimination on “other relevant ground.” a very wide and new term).
It aims to ensure that everyone is given an equal opportunity both when applying for a job and, having obtained it, during the employment itself.
As an employer:
- it is easy to discriminate without knowing you are doing so and without meaning to
- it is easy to find yourself on the end of a discrimination claim because of the actions of your employees
It is vital to ensure that correct policies and procedures are in place and that the workforce is fully trained.
Employers are vicariously liable for the actions of their employees so everyone in a business needs to understand what their obligations are and what they can and cannot do.
