Part-time Workers
With greater flexibility in the work place and more part time workers, employers must make sure they do not discriminate against part time workers by treating them less favourably.
In order to prove discrimination a part time worker must compare themselves with a full time worker employed in the same or similar work. If they have been treated less favourably then they may well have been discriminated against.
It is important that the right comparator is used and when faced with a claim a specialist must consider this aspect of an employee’s claim.
You should also watch out for a possible sex discrimination claim if a women employed on a part time basis is not treated in the same way as a male counterpart.
At Hart Brown we have advised many employers on all aspects of part-time workers including:
- the appropriate comparator
- procedures and policies relating to part time workers
- training of staff
- defending claims including justification
- settling claims
The amount of compensation that can be awarded is unlimited
