Race
It is possible to discriminate both directly and indirectly on the grounds of race. The Race Relations Act attempts to prevent this. Name calling and deliberately excluding employees because of their race are examples of possible race discrimination.
As an employer you could find that you have discriminated for reasons including:
- not handling the recruitment process fairly and objectively
- staff making inappropriate comments or banter and joking which you perceive as harmless but which is actually discriminatory conduct
- not following a proper procedure during the employment and being unable to justify decisions made
In addition you might find that the conduct amounts to harassment of the employee and that they become ill as a result. It might entitle them to bring a personal injury claim.
At Hart Brown we have advised many employers on how to manage such situations including:
- how to avoid race discrimination problems arising in the first place
- training of staff
- procedures and policies
- defending and settling claims
The amount of compensation that can be awarded is unlimited.
