Religion
Religion has divided people for centuries but under the Employment Equality (Religion or Belief) Regulations 2003 it is unlawful to directly or indirectly discriminate or subject to victimisation an employee on grounds of their religion, belief or philosophy.
It is even possible to discriminate against a person who has strong views on the protection of the environment.
At Hart Brown we have advised many employers on how to manage the issue of religion including:
- when it is possible to positively discriminate (for example Sikhs wearing a turban are excluded from the requirement to wear a safety helmet on building sites)
- training of staff to avoid inappropriate comments being made
- procedures needed to comply with the law
- how to ensure all employees are treated fairly while taking into account financial considerations
- how to deal with time off for religious days or ceremonies
- defending claims
- settling claims
