As an employer you are not obliged to give a reference to former employees.  However, a failure to do so could give rise to a claim. It is important to act consistently at all times and ensure that if you give a reference is not misleading, wrong or defamatory.  You could otherwise find yourself on the end of an expensive litigation claim.

You should seek legal advice if at all unsure and if you are planning on giving a non standard reference.
