Sickness

All employees are entitled to statutory sick pay (SSP) at a set rate if they are sick for more than 3 days. Often however, you as the employer may, as part of the employee benefit package, pay an employee who is sick more than the statutory entitlement. You may well offer full pay for a set period of time. Such clauses should be clearly set out in the employment contract.

Consideration should also be given to asking for:

  • a medical certificate if absent for a certain length of time through illness
  • in cases of long-term sickness absence an entitlement for you to ask for an independent medical examination by your nominated medical expert.
  • how absence is dealt with where it straddles 2 financial years
  • where the absence arises from an accident for which the employee is pursuing a claim for damages a requirement to pay back any loss of salary recovered.
