Compensation
If a successful unfair dismissal claim has been brought and the Employment Tribunal has decided to award compensation it will award it under 2 heads:
- a basic award calculated pursuant to a formula based on age, length of service and the value of one week’s pay subject to a statutory cap
- a compensatory award. This is designed to compensate the employee for the loss suffered as a result of the dismissal insofar as it is attributable to the action taken by their employer. This includes loss of earnings which the employee has suffered. The employee is under a duty to mitigate their loss by taking steps to find alternative employment and will need to show that they have done so. The compensatory award is subject to a statutory maximum amount.
