Illegal Activities
It is important to understand what notifications amount to a disclosure which are protected under PIDA (“Public Interest Disclosure Act 1998”).
Similarly an employee has to comply with specific requirements in order to gain protection under PIDA. Accordingly not all disclosures will be protected.
Illegal activities that may occur in your business can include:
- topical whistle blowing disclosures involving the dumping of toxic waste
- fraudulent accounting
- illegal contracts
- tax evasion
- danger to the health and safety of any individual by the employer.
- damage to the environment by the employer.
- the deliberate concealing of information about any of the above by the employer
Handling any disclosure is key to ensuring you are not faced with a costly claim and in some cases a criminal prosecution. At Hart Brown we can advise you on whether a protected disclosure has been made, whether your employee is protected under the Act and how best to resolve it.
