Financial Advisers

The growth in recent years of an investment culture, combined with an ever expanding range of investment products or “opportunities” apparently capable of being “managed” over the internet, has led to an ever increasing range of occupations and specialities.

Relevant financial activities include: research, analysis, reporting, advice, custody, management, dealing, regulation, compliance and administration.  Developments in the range of activities and the types of people carrying out those activities has been matched by increasing government regulation (for example The Financial Services and Markets Act 2000 and its predecessor The Financial Services Act 1986).  This has done little, if anything, to reduce the number of claims.

In terms of advising on these cases we are able to call upon the extensive knowledge and expertise of our own Investment Department whether the professional negligence claim is against the ultimate investment fund managers or the independent financial adviser in the middle.

The duties and liabilities of financial advisers and institutions may need to be considered from a number of different angles.  For example has there been:

  • breach of a statutory provision
  • breach of a relevant code of practice
  • negligence - the failure to act with the degree of care and skill to be expected of a reasonably competent financial adviser.

If you need to sue a financial advisor you need to use the services of a specialist professional negligence lawyer.  We will cut through perhaps mountains of paperwork and advise you exactly where you stand legally and what the best strategy is for achieving the best outcome.

To speak to a specialist professional negligence lawyer who can help you with your professional negligence claim against a financial adviser or any other professional contact us today by  call, email or request a call back from one of our specialist lawyers.
