Deeds of Covenant

A deed of covenant is an agreement where a buyer of a property agrees to comply with the rules and conditions affecting the property as set out in the Lease.

When a lease is assigned the new tenant normally signs a deed of covenant. This then binds the new tenant in the same way as the former tenant.

Often if the landlord’s consent to the assignment is required they will make it a condition of their consent that the new tenant signs a deed of covenant.

However they cannot always insist on this nor can they always force a new tenant to sign a deed of covenant.
