Rights of Light

A right of light is an easement and can be acquired by:

  • 20 years uninterrupted enjoyment ( provided it was not as a result of written permission)
  • an express grant
  • an express reservation,
  • the Prescription Act of 1832

The purpose of rights to light is to protect the light received through windows in existing buildings from unreasonable interference by new buildings. Openings are entitled to “adequate light for the ordinary notions of mankind”.

 It can be a particular problem on redevelopment and care needs to be taken if you are planning on building an extension or other development. You will need to consider the effect on your neighbour.
