Estate Administration Disputes

The personal representatives of the estate of someone who has died have both powers and duties but what happens if they do not do what they are supposed to do?

The administration of an estate can take time if the deceased left their affairs in a mess or the estate is complicated e.g. because of foreign assets or shares in a small private company which may be difficult to value.  Sometimes however the lack of progress is deliberate and in those circumstances consideration should be given to:

  • making an application to remove personal representatives (PRs) from office.
  • taking action against PRs to force them to get on with administering the Estate.

Since there is always a risk of the Estate being ordered to pay the costs of any litigation it is important to instruct someone with expertise and experience in this area to ensure that these disputes are handled as pragmatically and cost effectively as possible.
