Breach of Contract

When you are contracting with a builder/developer, architect, surveyor or engineer (and whether it is a small extension or a major development), it is important to have a written contract which clearly sets out as a bare minimum:

  • the exact works to be done by all of the parties involved 
  • the payment terms and in particular whether payments have to be certified or signed off by an architect or surveyor 
  • how any dispute should be handled for example whether through arbitration, adjudication, mediation or the courts
