Boundary Disputes
Falling out with a neighbour over a boundary dispute can make ongoing relationships difficult. Whether it relates to moving walls, fences or cutting down hedges, these situations can become unpleasant.
It is a complicated area of law and can involve considering various legal principles including:
- viewing the situation on the ground
- reviewing all title deeds and other documents going back many years
- considering the positioning of trees hedges and ditches
Working out exactly who owns which bit of land can therefore be something of a challenge. Other related issues such as rights of access, rights of way, trespass, nuisance, parking, repairs and maintenance and party wall disputes might further complicate matters.
It is important to be certain where the boundaries are when you buy a property but if you do find yourself in a situation where a claim arises over who owns what or there are allegations of trespass, it is important that you seek advice from someone experienced in dealing with these cases before the dispute gets out of hand.
We believe that our role is to help identify, on the basis of the available evidence, where the boundary should be and then encourage communications between the neighbours to help find a cost effective solution. This will avoid the delay, inconvenience and expense of perhaps an emotionally draining court case.
