Party Wall Disputes
Disputes often arise when a property owner is repairing, extending or demolishing a party wall and the adjoining owner or neighbour is worried that:
- this might cause a lot of inconvenience
- the work will not be carried out to a reasonable standard
- their own property will be damaged in the process.
A building owner carrying out works must comply with certain obligations under the Party Wall Act 1996. This includes serving notice on the neighbour of their intention to begin building work affecting a party wall. Failure to comply with the provisions of the Act may give rise to a claim for compensation and if sufficiently serious an injunction.
