Property Disputes - Landlord
We regularly act for both residential and commercial landlords in recovering possession of premises whether they are let under an assured short hold tenancy, a licence, a long lease or a commercial lease.
The main reasons for seeking possession of a property or forfeiture of a lease include
- rent arrears
- that the fixed period of the tenancy has come to an end but the tenant has not left the property
- that the tenant is in breach of any one of their obligations under the lease or tenancy agreement
- that the landlord requires the premises for redevelopment
These are not the only grounds.
This is a complex and heavily regulated area of law. A failure to follow the correct procedure will not only delay an application for possession but can invalidate the whole process. Wrongful re-entry into the premises by a landlord without a court order can give rise to claims for damages by the tenant for unlawful eviction and trespass.
