Service Charge Disputes
Service charges are payments for services relating to the general maintenance of a property’s communal areas/services such as lifts, lighting or gardens. Unfortunately they are frequently a source of dispute between tenants and landlords.
Our experience is that the main areas of dispute are:
- the amount of the charges
- a failure to carry out any works
- the standard of the works
We regularly advise both residential and commercial tenants about a landlord’s failure to carry out works forming part of the service charges even when the service charge has been paid.
We can advise on when it is possible to withhold payment of the service charge until relevant works have been completed and what to do when the landlord or management company simply fails to carry out their obligations at all.
