Age

Although age discrimination is generally thought of as discrimination against older people it actually includes discrimination against any age. The Equality (Age) Regulations make any discrimination on the grounds of age unlawful.

Discrimination can take many forms including:

  • failing to promote or train an older person because of their age
  • offering benefits to employees of a certain age and above meaning that younger people cannot receive them
  • using age as a criteria for selecting someone for redundancy
  • forcing retirement

We have advised many employees on matters including:

  • the effect of an employer having a standard retirement age
  • an employer trying to retire an employee who does not want to retire or asks to work beyond the standard retirement age
  • the presence of long term service benefits which disadvantage younger workers
  • defending a claim for justified discrimination
