Sickness
If, as an employee, you are sick for more than 3 days you are entitled to statutory sick pay (SSP) at a set rate. Often, however, your employer will, as part of an employee benefit package, pay an employee who is sick more than the statutory entitlement. They might be prepared to pay full pay for a set period of time. Your employment contract should state what you are entitled to.
Your contract might also require you to do the following:
- provide a medical certificate if you are absent for a certain length of time through illness
- in cases of long-term sickness absence require you to be examined by an independent medical expert nominated by your employer
- where the absence arises from an accident and you are pursuing a claim for damages require you to pay back any lost salary you receive as part of your damages claim
We at Hart Brown can help with any questions you might have if you find yourself ill with an unsympathetic employer. If your illness or absence is as a result of something that has happened at work you might also be entitled to claim compensation.
