Compensation
If you have succeeded in an unfair or constructive dismissal claim and the employment tribunal decides to award compensation this will be made up of:
- a basic award based on a formula taking into account age, length of service and the value of one week’s pay (which is subject to a statutory cap)
- a compensatory award which is subject to a statutory maximum amount. The compensatory award is designed to compensate the employee for the loss suffered as a result of the dismissal provided that it is caused by the action taken by the employer
Compensation usually includes any loss of earnings which you have suffered but you are under a duty to mitigate your losses by taking steps to find alternative employment. You will need to show that you have actively been looking for other work.
The level of compensation which can be awarded in some claims such as discrimination can also include injury to feelings. Depending on the exact nature of the claim guidelines do exist.
