Whistle Blowing
Whistle blowing has become a popular term to describe a situation where an employee reveals to the outside world information about an employer’s malpractice. The Public Interest Disclosure Act 1998 (PIDA) provides legal protection for workers and employees who make a disclosure or report malpractice by their employers.
If you become aware of something which could involve blowing the whistle it is important that you make the disclosure to the right person in the organisation otherwise you might lose the protection which PIDA provides.
If however, you make a so called “protected disclosure” and as a result your employer dismisses you or makes life difficult for you, you might have a claim for automatic unfair dismissal. If successful, the compensation is unlimited.
This is a complex area of law and requires specialist advice. We at Hart Brown have advised many clients on how best to approach breaches of contract and illegal conduct by employers. Health and Safety issues for example often raise concerns. They need to be addressed quickly to ensure that no-one is hurt.
