Occupation Orders
If you want to:
- prohibit a person from coming within a certain distance of you and/or your children and/or your home
- regulate the basis on which you both occupy your home, for example, by specifying the days and times each of you can live there
you can apply for an occupation order.
A court when deciding whether to grant an occupation order will take into account:
- each party’s financial resources
- whether either party can live elsewhere
- the nature of the conduct complained of
