Variation of Existing Orders

Once a court order has been made it is legally binding on both of you. A failure to comply can have serious consequences.

Sometimes, however, with the passage of time and a change in circumstances, the order might no-longer be appropriate. One party might need to apply to the court to change it (seek a variation).

If you are paying maintenance and your income has dropped or you have been made redundant you may need to change the amount of maintenance which you pay.

Alternatively you may think that the maintenance payment should be increased because the payer is now earning more.

When seeking a variation of maintenance both of you must again set out your income and capital position.

We will help you try to reach agreement on a variation. You might want to consider alternatives such as payment of a lump sum in lieu of maintenance. This would achieve a clean break severing all financial ties other than child maintenance.

If agreement cannot be reached we will help you through the court proceedings and deal with all the court paper work.
