Collaborative Process
At Hart Brown our family team includes lawyers who are trained in the collaborative process.
The collaborative process is an alternative method of trying to resolving your issues in addition to the conventional way of negotiation by correspondence, telephone, mediation, roundtable meetings or court.
The process involves the parties and their lawyers signing a “participation agreement” in which they all agree to work together and not go to court for the duration of the process.
In this way you will be part of the negotiation which takes place in meetings which you attend.
If agreement cannot be reached, either party, or their lawyers, can withdraw from the process. court action might then be the only option.
The collaborative process and mediation can be used for all types of disputes relating to finances and children.
If court proceedings are already in hand, then you will not be able to use the collaborative process. Roundtable meetings may be more appropriate.
