Mediation
Mediation involves the appointment of an independent mediator who helps parties try and reach agreement.
Mediations:
- usually take place on neutral ground
- are managed by the mediator
- are explained to you by the mediator
- seek to take into account similar considerations as would be taken by a court
- are assisted by the mediator in reaching a settlement
- will look at the various options open to both of you
- reality test the options to ascertain which is the most appropriate
If agreement is reached both of you must instruct your lawyer to check the agreement and if approved, the agreement is lodged with the court if divorce proceedings have been started or drawn up into a Separation Agreement if they have not.
Mediation and the Collaborative process can be used for all types of disputes in relation to finances or children.
