Accidents at Work

If you are involved in an accident at work, you need to use lawyers who understand the issues that commonly arise. Obtaining witness statements from other employees may be a challenge if they fear that their own job prospects will be affected. It is not just a question of suing a person you have never met before such as another car driver; you may need to criticise the actions of a work colleague/friend. It is often important to act quickly in a workplace injury claim:

  • to preserve machinery/equipment as it was at the time of the accident
  • to photograph equipment and the work environment before it is altered
  • to ensure that documents such as maintenance/training records do not “miraculously” disappear

As well as investigating whether there is employer negligence in failing to operate a safe system of work, there are numerous regulations to consider including those covering:

  • work and safety equipment including protective clothing
  • lifting and other manual handling operations
  • the carrying out of risk assessments
  • health and safety training
  • hazardous substances
  • working at heights
  • display screen equipment

Different regulations apply to different work environments including factories, offices, shops and building sites. We have also acted for a number of service personnel in claims against the Ministry of Defence arising from injuries at work.  We also deal with repetitive strain injury (RSI) claims.

If there is a related employment claim we will also be able to handle that.
