Accidents Involving Children
Claims involving children need to be handled with particular care and sensitivity. Parents are understandably upset that their child has been hurt and witness statement evidence can be difficult to obtain especially if other children are involved. Depending on the child’s age there can often be allegations of contributory negligence.
If the child is young and the injuries are serious they will have to live with the consequences for many years to come affecting their education, their career and future relationships. The effects of the original injuries may become more significant over time, and if there is a risk of a related condition developing in future it may be appropriate to claim provisional damages. If their life expectancy is reduced it may have a significant impact on the amount of damages.
If Court proceedings have to be issued then someone (usually a parent) will need to be appointed as a litigation friend to act on the child’s behalf. Finally the majority of so called “infant settlements” will require approval by a judge.
If your child has been injured in an accident you can trust Hart Brown to look after their interests and get them the compensation they deserve.
