Assault Cases
If you are injured as a result of an assault (including a sexual assault) there are, depending on the circumstances, two possible claims:
- a claim against your attacker for assault and battery
- a claim under the Criminal Injuries Compensation Scheme
If there is a crowd of people and alcohol is involved it is sometimes difficult to piece together afterwards exactly what happened. Witness evidence is crucial as we will need as much information as possible to help your case.
If you have been assaulted you should:- get photographs of your injuries at the earliest opportunity
- get the names of witnesses
- report the matter to the police so that there is an official record of the incident
In a lot of situations your attacker will not be insured against an assault claim and may not be worth suing. If however you are assaulted by somebody acting in the course of their employment in a pub or nightclub then you may be able to sue their employer who may have insurance or be worth suing.
Sometimes these cases involve one off sexual assaults or prolonged periods of sexual abuse. Although there may often be related criminal proceedings it is not necessary to obtain a criminal conviction in order to pursue a compensation claim.
