Criminal Injury Claims

If you are injured as a result of a criminal act and you are not able to recover damages from the other person, some compensation can still be obtained from the government under the Criminal Injuries Compensation Scheme.

Unlike other accident claims:

  • compensation for the actual injuries is worked out not by reference to previous case law but by reference to a government set tariff
  • there are limits on what can be claimed in terms of losses and expenses
  • legal costs incurred in dealing with these claims are not generally recoverable

For that reason you would only be able to use our specialist personal injury lawyers on what is known as a contingency fee basis. In other words our charges would be based on a percentage of the damages recovered by you for your criminal injuries claim. If your attacker is either worth suing in their own right, insured or is employed by an organisation that is worth suing or insured you will generally be better off instructing us to pursue an assault claim through the courts where costs are generally recoverable from the other side on top of the damages.
