Slipping/Tripping Claims

Most tripping accidents happen on the “highways and byways” and involve people tripping over uneven pavements, potholes in roads or pathways or falling down where somebody such as a utility company has been digging or laying pipes.

It is important to find out whether it is the local highway authority or some other organisation which is responsible for the problem. If you do suffer an injury as a result of falling over then it is vital to get photographic evidence as soon as possible before the defect is repaired.  We will also want to get statements from anyone else who may have fallen in the same place previously. 

Whether the claim is based on negligence or breach of statutory duty under The Highways Act 1980 the local highway authority will generally be responsible for maintaining the public highway (which includes pavements). They do have a possible defence if they can show that they had a reasonable system of inspection and maintenance which was in operation at the time of the accident. These fall claims often involve careful analysis of detailed documents by specialist lawyers who know what they are looking for.

Slipping accidents are more likely to happen in shops, pubs, restaurants, hotels, hospitals and other buildings open to the public. Once again in the absence of a previous accident in the same place it will be a question of studying cleaning and maintenance records.
