Stress at Work Claims

Stress at work claims are often vigorously defended because they involve criticism of the way in which an employer looks after its employees.  Not only is this bad publicity but certainly in larger companies may create a damaging precedent. An employee buckling under the stresses and strains of an excessive work load faces a difficult choice.  If you tell your employer that you are not coping with the job and the related stress is causing depression your future employment prospects may be damaged.  On the other hand if you do not tell your employer about the effect that your working environment is having on you, your employer may be able to escape liability for any subsequent nervous breakdown.

These cases are often challenging because:

  • other employees may be reluctant to give evidence against their employers in case it affects their own job prospects.
  • if, in a bullying case, the problem is your immediate boss you may be reluctant to complain for fear that the situation will get even worse.
  • there may be no written records to confirm that your employer was aware of the problems but did nothing to help. 
  • larger employers often claim that advertising an independent counselling service fulfils the duties that they owe to their employees.
