Disputes

The personal representatives of an estate have both powers and duties but what happens if they do not do what they are supposed to do?

The administration of an estate can take time if the deceased left their affairs in a mess or the estate is complicated.  Foreign assets or shares in a small private company may be difficult to value.  Sometimes, however, the lack of progress is deliberate and in those circumstances you could consider:

  • making an application to remove personal representatives from office
  • taking action against personal representatives to force them to administer the estate

If the matter ends up in court there is a risk of at least some of the costs being ordered to be paid out of the estate.  For that reason, it is important to instruct someone with expertise and experience in this area so that these disputes are handled as pragmatically and cost effectively as possible.
