Court of Protection
The Court of Protection (CoP) is the court which looks after the affairs of those who are unable to make their own decisions because of mental incapacity. The CoP works closely with the Office of the Public Guardian (OPG). In recent years the CoP and OPG have both been completely revamped.
The main roles that the CoP has in relation to helping those with mental capacity are:
- to decide whether a person has the capacity to make a particular decision for themselves
- to make orders or decisions about those who cannot do so for themselves
- to appoint deputies to make decisions for such people
- to remove deputies or attorneys who fail to carry out their duties properly
- to decide whether a Lasting Power of Attorney or Enduring Power of Attorney is valid
