Enduring Powers of Attorney

An Enduring Power of Attorney (EPA) is a document by which a person, known as the donor, gives authority to another person, known as the attorney, to deal with their property and financial affairs

EPA’s made prior to 30th September 2007  remain valid but since that date Lasting Powers of Attorney have now replaced EPAs

The ‘enduring’ part of an EPA refers to the fact that the power endures or continues beyond the time when the donor loses mental capacity.  If, in the opinion of the attorney, the donor is losing or has lost capacity then they are obliged to register the EPA with the Office of the Public Guardian  or OPG.  Once registered with the OPG the EPA can be used to assist in looking after the donor’s affairs.
